What is Dress Up?
- Who we are. Dress Up SRL, registered at Viale Premuda, 46 – 20129 Milan (Italy).
- International availability. Services are offered within the EU, UAE, and other lawful jurisdictions. Some terms may vary to comply with local laws.
- Data protection. Personal data is handled per our Privacy Policy and applicable data protection laws including GDPR. Data may be processed outside the EU using appropriate safeguards.
- What we do. Dress Up operates a peer-to-peer marketplace (“Marketplace”) enabling independent lenders (“Lenders”) to list clothing items for rent or sale to renters (“Renters”) via the mobile app (“App”) and website app.dressup.ae (“Website”). Collectively, these are the “Services”.
- Terms structure. These Terms include this document plus the Privacy Policy and other requirements posted on the App or Website.
- Acceptance. By accessing the Services you agree to the Terms. Do not use the Services if you disagree.
- Updates. Terms and the Privacy Policy may change; updates will be posted in the App/Website or communicated via email/notifications. Continued use indicates acceptance of changes.
- Eligibility. You must be 18+ to use the Services. Users under 18 require guardian consent.
- Marketplace role. Dress Up provides the platform but does not guarantee item quality or pricing. Contracts are formed directly between Lenders and Renters.
- No agency. Dress Up is not a party to Lender-Renter agreements except when acting as a payment collection agent for Lenders.
Setting Up Your Account
- Account creation. Lenders and Renters must register with accurate information and may be asked for additional ID.
- Password security. Use strong passwords and keep them confidential. Report suspected misuse to customersupport@dressupstore.it.
- Deactivation. Email customersupport@dressupstore.it with the subject “account deactivation” to close your account.
Your Right to Use the Service
- Ownership. Dress Up or its licensors retain rights over Service materials; you may only use them under these Terms.
- Personal use. Access is personal; do not transfer or share your rights.
- Restrictions. Unless permitted by Dress Up, you must not copy, redistribute, modify, reverse engineer, or otherwise tamper with the Services.
- Accuracy. The Services may contain errors; Dress Up is not liable for correcting them.
- Linked sites. Dress Up is not responsible for third-party sites linked from the Services.
- Third-party materials. Content supplied by third parties remains their responsibility.
- App store terms. App downloads via Apple App Store or Google Play are also subject to their respective terms.
- User content. Content uploaded (photos, descriptions, reviews) must comply with the Acceptable Use Policy.
- Licence to Dress Up. You retain ownership of User Content but grant Dress Up a worldwide, royalty-free licence to use it to operate the Services.
- Monitoring. Dress Up may remove content violating policies.
Lender Specific Terms
- Categories. List items within approved categories; contact support if a category is missing.
- Descriptions. Items must match descriptions and be safe/fit for use. Disclose and show any damage.
- Listings. After KYC, submit listings for Dress Up categorisation review. Dress Up does not verify pricing or quality.
- Images. Provide your own images that comply with policy. Rankings are determined by Dress Up algorithms.
- Condition proof. Keep dated photos taken within 24 hours before shipping to document condition.
- Cancellations. Frequent last-minute cancellations may trigger reviews or pauses.
- Lender responsibilities. You must own the rights to items, deliver them as agreed, include all safety/usage info, ensure legality, and provide accurate representations.
- Lender rental policy. Define pricing, delivery costs, fit/refund policy, and cancellation terms (including cooling-off periods and consequences for late cancellations).
- Contract terms. Once agreed with a Renter, do not change rental terms without mutual consent.
- Removing listings. You may remove listings or cancel rentals up to 48 hours before start time. Later cancellations may incur a 30% fee.
- Verified Lender Program. Verified Lenders may offer items for sale and are indicated by a blue tick. Sales must meet section 4 requirements, and sellers remain liable for accuracy.
Renter Specific Terms
- Licence to use items. Renting grants you personal use for the agreed period only.
- Responsibilities. Ensure you can legally use the item, follow applicable laws, comply with Lender instructions, and return it in original condition.
- Returns. Return items by the agreed date unless otherwise authorised.
- Damage. Lenders may charge for damage or loss beyond normal wear. Document issues promptly.
- Purchases from Verified Lenders. Purchase terms mirror Lender rental policies but apply to sales.
- Late returns. Notify the Lender if you anticipate delays. Extensions may require extra payment. Additional fees can apply if items are late beyond a specified longstop date.
- Theft. Theft or attempted theft may trigger legal action.
Postage
- Tracked shipping. Dress Up recommends tracked and insured shipping. Senders are liable for loss/damage during transit.
- Tracking info. Provide tracking numbers for every shipment. Missing tracking may prevent dispute support and can trigger late fees if items are assumed undelivered.
Fees and Payment
- Rental Fees. Displayed on listings and collected when bookings are confirmed.
- Lender payouts. Dress Up collects rental fees on the Lender’s behalf and deducts a 20% + VAT commission (or updated rate) before sending payouts via Stripe.
- Currency handling. Payments may be processed in multiple currencies. Exchange rates/fees may apply.
- Unpaid amounts. Dress Up may charge saved payment methods for unpaid fees, losses, or damages.
- Taxes. Lenders are responsible for reporting and remitting applicable taxes.
- Security deposits. Returned within 10 business days of cancellation when applicable.
- Suspension for non-payment. Accounts may be suspended if payments remain outstanding after notice.
- Gift cards. Valid for 12 months after being added to an account.
- Promotions. Codes, prizes, and credits are applied to qualifying orders subject to promo terms.
- Refunds/credits. Users may choose between cash refunds and account credit when eligible.
Notice & Takedown
- Reporting infringements. Email notices must include contact info, details of the infringement, and links to content.
- Response. Dress Up will review and determine appropriate action.
Disputes
- With Dress Up. Contact support first to resolve issues informally.
- Between users. Resolve directly where possible. Dress Up’s Disputes Team can assist but is not obligated to resolve cases.
- Evidence. Provide detailed documentation for any claim.
- Timing. Report disputes within 7 days of rental end.
- Final decision. If Dress Up renders a decision, users agree to comply without prejudice to statutory rights.
Ending the Relationship
- Opting out. Stop using the Services if you disagree with the Terms.
- Suspension. Dress Up may suspend or terminate accounts for policy breaches.
- Content removal. Upon termination, Dress Up may delete User Content; retain copies for your records.
- Outstanding amounts. Termination does not cancel payment obligations.
Liability
- Foreseeable losses. Dress Up is liable only for foreseeable losses caused by breaching the Terms or failing to use reasonable care.
- No unlawful exclusions. Liability is not excluded for death/personal injury or fraud.
- No business liability. Dress Up is not responsible for commercial or resale losses.
- No verification. Items are not independently verified by Dress Up.
Other Important Terms
- Force majeure. Dress Up is not responsible for events outside its control (e.g., outages).
- Entire agreement. These Terms and referenced documents form the complete agreement.
- Assignment. Dress Up may assign its rights/obligations; users need consent to transfer theirs.
- No agency. Users cannot bind Dress Up to contracts.
- Governing law.
- EU users: Italian law; disputes in Milan courts subject to EU consumer protections.
- UAE users: UAE law; disputes in competent UAE courts where required.
- Consumer rights: Mandatory local protections remain unaffected.
